Terms of Service

Effective Date: March 9, 2026

PLEASE READ THESE TERMS CAREFULLY. They contain an agreement to arbitrate and class action waiver (Article 9). By creating an account, purchasing Gems, or entering any Tournament on Eternel Games, you agree to be bound by these Terms of Service, our Privacy Policy, and our Game Rules(collectively, the “Agreement”). If you do not agree, do not use the Platform.

Gems are virtual in-game currency. Gems have no monetary value, cannot be redeemed, exchanged, or withdrawn for cash or any other consideration, and are non-transferable outside the Platform. All Gem purchases are final.

Article 1 — Definitions

In these Terms, the following words have specific meanings:

  • “Platform” means Eternel Games, accessible at eternel.games and through associated mobile and web applications, including all services, features, and content.
  • “Operator” means Eternel Games LLC, the entity that owns and operates the Platform.
  • “User” or “Player” means any person who creates an account on the Platform.
  • “Game” means Serpenta Battle Royale, the competitive multiplayer tournament game currently offered on the Platform.
  • “Tournament” means a single Serpenta Battle Royale match in which up to 12 players compete based on their in-game performance and final placement.
  • “Gems” means the virtual in-game currency used to enter Tournaments and earn rewards. Gems are an entitlement to in-game features only. Gems have no monetary value, cannot be redeemed for cash, and are non-transferable outside the Platform.
  • “Entry Cost” means the amount of Gems required to join a Tournament.
  • “Tier” means a Tournament level with a specific Entry Cost in Gems. Tier costs and prize distributions are displayed in the lobby and may be adjusted from time to time.
  • “Prize Pool” means the Gems distributed to top finishers of a Tournament according to the rules displayed in the lobby for that Tier.
  • “Gem Balance” means the Player’s current Gem holdings on the Platform. Gem Balance is not money and not redeemable for money.

Article 2 — Eligibility & Account

2.1 Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or purchase Gems. Free practice gameplay may be used by users of any age where lawful.

2.2 One Account Per Person

Each person may hold only one account. Creating or operating multiple accounts (“multi-accounting”) is strictly prohibited and will result in permanent ban and forfeiture of all Gems.

2.3 Account Security

Your account is personal and non-transferable. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify the Operator immediately if you suspect unauthorized access.

2.4 Account Suspension

The Operator reserves the right to suspend, restrict, or permanently terminate any account that violates these Terms, at its sole discretion and without prior notice where necessary to prevent fraud, abuse, or legal non-compliance.

Article 3 — Game Rules & Mechanics

3.1 Nature of the Game

Eternel Games currently offers Serpenta Battle Royale, a real-time multiplayer competitive tournament. All game outcomes are determined by player input and fixed game rules — no random number generator (RNG) determines the outcome of any player-versus-player encounter. 3.2 Tiers & Entry Costs

Tournaments are organized into Tiers, each with a fixed Entry Cost denominated in Gems. The current set of Tiers, their Entry Costs, and their prize distributions are displayed in the lobby. The Operator may add, remove, or adjust Tiers from time to time; changes are communicated through the lobby UI.

The Entry Cost is charged in Gems upon joining a Tournament lobby and is non-refundable once the game countdown begins. If a Tournament fails to start (e.g., server error), Entry Costs are refunded in Gems.

3.3 Tournament Format

Serpenta Battle Royale is a fill-and-lock tournament for up to 12 players. Once the lobby reaches capacity, a 5-second countdown begins and no new players may join. A shrinking safe zone forces players into progressively smaller areas. The last player standing wins.

3.4 Prize Distribution

The Prize Pool is awarded in Gems to the top finishers according to the distribution shown in the lobby for that Tier. Prizes are credited instantly to the winners’ Gem Balance upon game completion. Players who do not place forfeit their Entry Cost.

3.5 Free Practice

Free practice modes involve no Gem entry. They exist to learn game mechanics. Free practice is available to all users worldwide.

3.6 Game Parameter Changes

The Operator may adjust game parameters (including but not limited to Entry Costs, prize distributions, player counts, and zone behavior) at any time. Material changes will be communicated via the Platform.

Article 4 — Gems & Purchases

4.1 Nature of Gems

Gems are virtual in-game currency sold by the Operator and used solely to access in-game features such as Tournament entries. Gems are not money, do not represent any monetary value, and are not stored value, e-money, or any kind of financial instrument.

Gems cannot be redeemed, exchanged, transferred, or withdrawn for cash, cryptocurrency, fiat, goods, or services outside the Platform. Gems have no value off the Platform and may not be sold or traded between Users or to any third party.

4.2 Purchasing Gems

Gems may be purchased through the Platform using supported payment methods. Pricing for Gem packs is displayed at the point of purchase. All Gem purchases are final and non-refundable, except where required by applicable law or where a purchase fails to complete due to a Platform error.

4.3 No Withdrawals

The Platform does not support withdrawals, cash-outs, payouts, or any conversion of Gems back into money or any other off-platform value. Players who do not accept this limitation should not purchase Gems.

4.4 Forfeiture & Account Closure

Gems remaining in a Player’s account at the time of account closure (whether by the Player or by the Operator) are forfeited and have no residual value. Gems may also be removed from accounts in cases of fraud, chargeback, prohibited conduct, or violation of these Terms.

Article 5 — Prohibited Conduct

The following conduct is strictly prohibited on the Platform:

  • Collusion or teaming — coordinating with other players in a Tournament to gain unfair advantage
  • Multi-accounting — creating or using more than one account
  • Automation — use of bots, scripts, macros, or any automation tools
  • Bug exploitation — exploiting bugs, glitches, or unintended behavior (players must report these immediately)
  • Feeding — intentionally losing or transferring value to another player
  • Account trading — sharing, selling, or transferring accounts or Gems
  • Chargeback abuse — initiating chargebacks for legitimately delivered Gem purchases
  • Abuse — harassment, hate speech, threats, or abusive behavior toward other players or staff
  • Tampering — attempting to reverse-engineer, decompile, hack, or disrupt the Platform or its infrastructure
  • Underage play — purchasing Gems while under the minimum age requirement

Penalties: Violations may result in, at the Operator’s sole discretion: a warning, temporary suspension, permanent ban, and/or forfeiture of Gem Balance. The Operator may report suspected illegal activity to the appropriate authorities.

Article 6 — Anti-Teaming & Fair Play

The Platform uses automated behavioral detection systems to identify collusion and teaming. Detection methods include proximity analysis, movement pattern correlation, selective non-aggression tracking, and statistical anomaly detection.

Players flagged for teaming may receive in-game penalties or account sanctions. The Operator’s determination of collusion is final.

Players may appeal sanctions by contacting contact@eternel.games with their account details and a description of the situation. Appeals will be reviewed within 5 business days.

Article 7 — Performance-Based Competition Classification

Eternel Games operates competitions in which outcomes are determined by player actions: real-time movement control, strategic positioning, boost timing, combat decisions, and zone management.

No random number generator (RNG) determines the outcome of any player-versus-player encounter. Specifically:

  • Deterministic combat — collision outcomes are resolved by fixed rules based on speed, boost status, and size. No randomness is involved.
  • Symmetric conditions — all players start with the same base stats. The shrinking zone and food spawns apply equally to all players.
  • Complete information — all game state is visible to all players. There is no hidden information or asymmetric advantage.
  • Skill-expressive mechanics — movement, boost management, spatial awareness, and strategic decision-making are the determining factors in every outcome.

Because Gems have no monetary value and cannot be withdrawn or redeemed for cash, Tournament play on the Platform does not involve a wager of money for a money prize. For a detailed explanation of the Platform’s competitive structure, see our FAQ.

Article 8 — Intellectual Property

All game content, code, graphics, sounds, trade names, trademarks, and branding are owned by Eternel Games LLC or its licensors. The Eternel Games name, logo, and brand are trademarks of the Operator. All rights not expressly granted herein are reserved.

Player-generated content (such as usernames and display names) grants the Platform a worldwide, non-exclusive, royalty-free license to display that content within the service. Players may not copy, redistribute, modify, or commercially exploit any Platform content without prior written consent from the Operator.

Article 9 — Dispute Resolution & Arbitration

9.1 Informal Resolution

Players should first contact support at contact@eternel.games. The Operator will respond within 48 hours and will attempt to resolve any dispute informally within 30 days.

9.2 Binding Arbitration

If a dispute cannot be resolved informally, it shall be submitted to binding arbitration administered by the International Chamber of Commerce (ICC) in accordance with ICC Rules of Arbitration. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be Cheyenne, Wyoming, United States. The language of arbitration shall be English.

9.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Operator.

9.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

9.5 Opt-Out

You may opt out of the arbitration agreement by sending written notice to contact@eternel.games within 30 days of creating your account. The notice must include your full name, account email, and a clear statement that you wish to opt out of binding arbitration.

Article 10 — Disclaimers & Limitation of Liability

The Platform is provided “AS IS” and “AS AVAILABLE.” The Operator makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Operator is not responsible for losses resulting from: internet connectivity issues, device failures, server outages, force majeure events, or any other circumstances beyond its reasonable control.

Server interruptions: In the event of a server failure during an active Tournament, the Operator will attempt to restore game state. If restoration is not possible, Entry Costs (in Gems) for affected sessions will be refunded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Operator’s total aggregate liability arising out of or relating to these Terms or your use of the Platform shall not exceed the amount paid by the Player to the Operator for Gem purchases in the 12 months preceding the claim, or US $100, whichever is greater.

The Operator is not responsible for losses from normal gameplay — losing Tournaments and consuming Gems is an inherent part of competitive gaming. Eternel Games is entertainment, not a financial product, investment, or gambling service.

Article 11 — Modifications to These Terms

The Operator may update these Terms at any time. Material changes will be communicated via email and/or in-app notification at least 14 days before taking effect.

Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. Players who disagree may close their account at any time before the changes take effect.

Article 12 — Termination

Players may close their account at any time by contacting support. Upon closure, any remaining Gem Balance is forfeited and has no residual value.

The Operator may terminate accounts for violation of these Terms. Upon termination for cause, the Operator may forfeit remaining Gems if the violation involves fraud, collusion, chargeback abuse, or other prohibited conduct under Article 5.

Article 13 — Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force and effect.
  • Entire agreement: These Terms, together with the Privacy Policy and Game Rules, constitute the entire agreement between you and the Operator regarding use of the Platform.
  • No waiver: The Operator’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it later.
  • Assignment: The Operator may assign its rights and obligations under these Terms without notice. Players may not assign their accounts or any rights under these Terms.
  • Force majeure: The Operator shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including natural disasters, war, terrorism, pandemic, government actions, or internet service disruptions.
  • Language: In the event of a conflict between translated versions and the English version of these Terms, the English version prevails.
